General Terms and Conditions of Contracting

1. General Information

This document sets out the general conditions that govern the use and purchase of products through the website www.enriquetomas.com, owned by ENRIQUE TOMÁS S.L., with Tax ID NIF B59544957 and registered office at C/ Holanda 27, 08917 Badalona (Barcelona), Spain.

2. Purpose

This website is intended for the remote sale of Iberian products and their accessories, primarily aimed at end consumers, in accordance with current regulations on e-commerce, consumer protection, and distance contracts.


3. Applicable Law

The contractual relationship between the user and ENRIQUE TOMÁS S.L. is governed by the following regulations:

  • Law 7/1998 of April 13, on General Terms and Conditions of Contracting

  • Royal Legislative Decree 1/2007 of November 16 (amended by Law 3/2014), General Law for the Protection of Consumers and Users

  • Law 34/2002 of July 11 on Information Society Services and Electronic Commerce

  • Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD) on personal data protection

  • Law 7/1996 of January 15 on the Regulation of Retail Trade


4. Modifications of the Conditions

ENRIQUE TOMÁS S.L. reserves the right to modify these conditions at any time without prior notice. Modifications are applicable from the date of publication on the website, unless otherwise explicitly stated. In case of substantial changes, registered users will be informed in advance.

Specific conditions may prevail over general conditions in case of contradiction, provided they are previously communicated to the user.


5. User Registration

To make purchases, registration as a user is required by creating an account with a username and password, which are personal and non-transferable.

The user agrees to keep this information confidential and to report any unauthorized use.

Through the customer area, the user can consult their order history and update personal information.


6. Legal Capacity

By accepting these terms, the user declares:

  • To be over 18 years of age

  • To have the legal capacity to enter into contracts

  • To have read, understood, and fully accepted these conditions


7. Purchase Process

The purchase process consists of the following steps:

  1. Product selection

  2. Add to cart

  3. Registration or login

  4. Enter shipping and billing information

  5. Choose payment method

  6. Order confirmation

After completing the purchase, the user will receive a confirmation email. If not received within 24 hours, customer service should be contacted via the Contact Form.


8. Prices and Taxes

All prices are in euros (€) and include the applicable Value Added Tax (VAT). Offers and prices apply exclusively to online purchases and may differ from prices in physical stores.


9. Payment Methods

The customer has several options to pay for their order:

a) Credit Card VISA or MASTERCARD
All transactions involving personal or banking data are carried out in a secure environment using SSL (Secure Sockets Layer) technology. Credit card information is entered directly on the bank’s POS page and is not stored on ENRIQUE TOMÁS S.L. servers.

In case of fraudulent or incorrect charges, the cardholder may request that the order not be processed if it has not left our warehouse. If the order has been shipped, the customer must file a report with the competent authorities.

b) Bank Transfer
When selecting bank transfer, you will receive an email with ENRIQUE TOMÁS S.L.’s banking details. The transfer must be completed within 3 days for the order to be validated. For international transfers, the sender must cover all fees.

c) PayPal
PayPal allows secure online payments using existing financial infrastructure, such as bank accounts and credit cards. More information: https://www.paypal.com

d) Scalapay
Payment in 3 installments. By using this service, you authorize the installment transaction unconditionally and irrevocably. Scalapay manages the payment to ensure a smooth customer experience.


10. Shipping Policy

a) National Shipments (Mainland Spain & Balearic Islands)

  • Mainland Spain: free for orders over €100

  • Balearic Islands: free for orders over €150

  • No shipping to: Canary Islands, Ceuta, Melilla

b) International Shipments

  • Portugal (Zone 4): free from €100

  • France, Germany, Italy (EU Zone): free from €200

  • Belgium, Luxembourg, Monaco, Netherlands (Zone 6): free from €300

  • Austria, Croatia, Czech Republic, Denmark, Finland, Greece, Hungary, Ireland, Poland, Romania, Sweden (Zone 7-71): free from €300

  • United Kingdom: free from £450

Important: Orders with 6 or more bottles incur shipping costs throughout Europe, regardless of total amount or destination.

c) Countries with Exceptions & Customs Fees

  • Switzerland & Liechtenstein: import customs fees for meat are the responsibility of the recipient

  • United Kingdom: EORI number required; customs fees always at the customer’s expense

  • Cyprus, Malta & Mediterranean islands: no free shipping

d) Calculation of Shipping Costs
Shipping costs are calculated automatically during checkout. Accepting general terms is required to complete the order. No shipping to unauthorized countries.

e) Delivery
Deliveries Monday to Friday (except local holidays), only to private addresses or offices. Please provide an address where someone is always available to receive the order.

f) Special Dates
Christmas campaign (Nov 1 – Dec 31): delivery times may double due to high order volume.

g) Receipt & Verification
The customer must check the package and contents immediately upon receipt. Failure to report issues within 7 days will be considered acceptance. For unavailable products, ENRIQUE TOMÁS S.L. will notify within 30 days, offering replacement or refund.


11. Returns & Non-Conformity

The customer has the right to return defective products or products that do not meet their expectations. The customer has a period of 15 days from the moment the product is received to notify Enrique Tomás of the defect or discrepancy and proceed with the return of the product.

If the customer returns the product due to defects or non-conformity, and the return is accepted, Enrique Tomás will replace the product with another of similar characteristics and cover the shipping costs as well as the direct return costs. If the item cannot be replaced due to unavailability, the amount will be refunded to the customer.

In the case of defects or non-conformity detected in hams, shoulder hams, and cured sausages, at least 85% of the product’s weight must be returned. In other words, opened pieces with more than 15% of the product missing will not be accepted. Hams and shoulder hams must be returned with the original seals, labels, or tags intact and without any manipulation.

Any whole piece (ham or shoulder ham) that has been sliced after delivery at your location by a company, butcher, or charcuterie that is not Enrique Tomás will not be subject to this protocol. To be eligible for this protocol, the piece must remain intact (not cut or deboned) and carry the Enrique Tomás black guarantee label.

The return protocol will also not apply if the product has been poorly stored after delivery.

If, upon opening a sliced pack, you do not find the expected flavor, and the same occurs with a second pack (we recommend trying a second one as the taste of the ham can vary depending on the part of the piece it comes from) and you confirm that you are not satisfied, we ask that you notify us immediately via our CONTACT FORM.

For other cured products, such as whole sausages, vacuum-packed products, hard and semi-hard cheeses, oils, or other non-food products, a solution will be provided according to the nature of the problem, as long as the claim is made within a maximum of 15 days from the receipt of the order.

After this period, the claims period will have expired and it will no longer be possible to offer a solution. Therefore, we recommend carefully checking the products upon arrival, paying particular attention to the integrity of the vacuum packaging.

Instructions for returning a product purchased from the Online Store:
If, despite all our strict quality controls, you are not satisfied with your product, whether because you do not like it or because there is a problem, you must inform us immediately. To do so, please contact our customer service through the CONTACT section and provide the following information:

  • Photos of the current state of the product, showing the defect and the guarantee seal.

  • A brief explanation of the issue.

  • Order number.

Once we receive this information, we will arrange to collect the product from your home. Once the product arrives at our facilities, our team of quality experts will analyze the product and find the best solution for you.


12. Right of Withdrawal

The buyer has 14 calendar days to exercise their right of withdrawal from receipt of the product without penalty or reason. Products must be unused and in original packaging.


13. Product Warranty

Non-perishable products have a 3-year legal warranty from delivery, covering manufacturing defects but not normal wear or misuse. Proof of purchase is required.


14. Data Protection

Personal data is processed under GDPR and LOPDGDD, exclusively for order management and authorized communications. Users may exercise their rights at:

15. Contract Language

The official language of the contract is Spanish. The website may be available in other languages, but the Spanish version prevails in case of discrepancies.


16. Limitation of Liability

ENRIQUE TOMÁS S.L. is not liable for:

  • Service interruptions due to technical issues or force majeure

  • Misuse of the website by the user


17. Dispute Resolution & Jurisdiction

The parties submit to the jurisdiction of the courts of Barcelona (Spain), expressly waiving any other jurisdiction.
